1. General Provisions

1.1. This public offer is the official proposal of the Serenity online store (hereinafter  – the “Seller”) to conclude a distance sales contract through the website https://www.serenity-wear.com (hereinafter — the “Website”).

1.2. The moment of full and unconditional acceptance of this offer (acceptance) is the fact of the Buyer’s payment for the order under the terms specified on the Website.

2. Terms and Definitions

2.1. “Goods” — clothing, accessories and other products presented on the Website.

2.2. “Online store” — a resource created for selling goods via electronic agreement in accordance with the Law of Ukraine “On Electronic Commerce”.

2.3. “Buyer” — an individual who has placed and paid for an order under the terms of this Agreement.

2.4. “Order” — a properly completed request by the Buyer to purchase Goods.

3. Subject of the Agreement

3.1. The Seller undertakes to transfer the Goods to the Buyer, and the Buyer undertakes to accept and pay for them.

3.2. This Agreement governs all stages of interaction between the parties: product selection, order placement, payment, processing, and delivery.

4. Order Procedure

4.1. The Buyer may place an order for any Goods available for purchase.

4.2. If the product is not in stock, the Company Manager is obliged to inform the Buyer (by phone or e-mail). The status “sold out” also serves as an indication of the lack of a position in the warehouse.

4.3. If the product is not available, the Buyer has the right to replace it with a product of a similar model, to refuse this product, to cancel the order.

5. Payment and Delivery

5.1. Payment is made using the methods available on the Website.

5.2. Delivery is carried out to the address specified by the Buyer, according to the conditions described in the “Delivery” section on the Website.

6. Rights and Obligations of the Parties

6.1. The Seller has the right to refuse to fulfill an order if the Buyer violates the terms of this Agreement.

6.2. The buyer is obliged to timely pay and receive the order under the terms of this contract.

6.3. The Buyer has the right to receive full information about the Goods, their characteristics, and delivery and payment terms.

7. Liability of the Parties

7.1. The Parties are liable in accordance with the current legislation of Ukraine.

7.2. The Seller is not liable for:

— minor differences in product colors due to individual device screen settings;

— delivery delays caused by factors beyond the Seller’s control;

— actions of the Buyer that violate the law.

7.3. In the event of force majeure, the Parties are released from fulfilling their obligations for the duration of such circumstances.

8. Return Policy

8.1. Returns of goods in proper condition are carried out in accordance with the legislation of Ukraine.

8.2. For фall orders, returns are at the Buyer’s expense.

9. Term of the Agreement

9.1. This Agreement comes into force at the moment of acceptance by the Buyer and remains valid until all obligations are fulfilled by both parties.
